Legal Notice
This page sets out how we use fragrance brand names, what a decant is and is not, and the Canadian rules that apply to selling one. It is written to be read, not to be skipped — the whole business depends on being straight about what you are buying.
We are not affiliated with any fragrance house
Perfume Decant is an independent Canadian business. We are not affiliated with, endorsed by, sponsored by, authorized by, or otherwise connected to any perfume house, brand, designer or their distributors. Nobody named on this site has approved us, supplied us at wholesale, or reviewed anything we have written.
All brand names, fragrance names, logos and trade dress are the property of their respective owners.
How we use brand names
We use brand and fragrance names only to identify the fragrance inside a decant — the same way a shop can say it sells a particular make of coffee beans without being that roaster. In trademark terms this is nominative use: naming the thing in order to describe it accurately, because there is no other way to tell you what is in the bottle.
We do not use brand logos or brand imagery in our own branding, packaging or advertising, and our decants ship in unbranded atomizers with our own labels. If you ever see a brand's logo presented as though it were ours, that is a mistake and we want to hear about it.
What a decant is
A decant is fragrance transferred by us out of a full retail bottle into a smaller glass atomizer. The liquid is the manufacturer's; the container is ours.
Every bottle we decant from is bought at retail by us. We do not use testers, we do not blend batches from different bottles, and we do not dilute anything. What is in a 5ml decant of a fragrance is the same liquid as what is in the 100ml bottle it came from.
What a decant is not
A decant is not retail-packaged product. It does not include the original bottle, the box, the cellophane, the batch code on the outer packaging, or anything else a boutique would hand you. It is not a manufacturer sample, and it is not sold as new-in-box.
Because the fragrance has left its original packaging, no manufacturer warranty, guarantee or authenticity programme applies to it. Our own commitments — that it is genuine, that it was bought at retail, that it is what the label says — are ours, and you are relying on us for them, not on the brand.
Cosmetic labelling and Canadian compliance
Fragrance sold in Canada is a regulated cosmetic under the Cosmetic Regulations, and the labelling rules that apply to it are not optional. We are working through what those rules require of a decant and are not going to claim compliance we have not reached — if you need the ingredient list for a particular fragrance before ordering, write to us and we will send you what the manufacturer publishes for it.
Fragrance is also a flammable liquid, classified UN1266 for transport. That is why everything we sell travels by ground, within Canada only, in rigid packaging rather than padded envelopes — the rules for limited quantities of flammable liquids require it, and no amount of paying extra makes air freight available for this category.
Ingredients, allergies and safety
Ingredient information comes from the manufacturer of the fragrance. We reproduce it; we do not verify or test it, and we cannot tell you anything about a formula that its maker has not published.
Fragrance is for external use on skin. If you have a known sensitivity, read the label before use and patch-test on a small area. Keep decants away from heat, flame and children. Nothing on this site is medical, dermatological or safety advice, and we are not qualified to give any.
Accuracy of what we publish
Note pyramids, release years and concentrations are compiled from manufacturer material and published fragrance references. Brands reformulate without announcement and without changing the packaging, so a note list can be accurate for one batch and wrong for the next. Where we describe how something wears, that is one person's experience of one batch on one skin, and yours may differ.
If you spot something wrong, tell us and we will correct it. We would rather be corrected than be confidently wrong on a page someone is about to spend money on.
Prices, availability and errors
Prices are in Canadian dollars and may change without notice. We may correct obvious pricing or description errors even after an order is placed; if that happens we will contact you and give you the choice of proceeding at the corrected price or cancelling for a full refund. We may also decline or cancel any order at our discretion — for example where a bottle turns out to be faulty and we would rather refund you than decant from it.
This site
The text, layout and photographs on this site are ours. Copying our product descriptions or guides wholesale is not something we will pretend to be relaxed about.
Product links on this site are our own; we do not carry third-party advertising and we are not paid to feature anything.
Governing law
These terms are governed by the laws of the Province of Manitoba and the federal laws of Canada that apply there. Nothing here limits the rights you have under applicable Canadian consumer protection legislation — where this page and that legislation disagree, the legislation wins.
